Abstract KHIT 136, Synthesis of Right to Take Challenges KYTC is facing an increasing number of right to take challenges, which delay its project delivery schedule. Issuing efficient and effective responses to these challenges is critical for completing projects in a timely manner. Understanding the basis for these challenges is critical if KYTC is to address them successfully in the future. OBJECTIVES Survey other state transportation agencies to identify those which resolve right to take challenges more quickly than KYTC. Provide a history of Kentucky law related to right to take issues. Identify trends in the adjudication of Kentucky right to take challenges through the collection and synthesis of case data. WORKPLAN Develop and administer survey. Review and summarize relevant Kentucky law, including the constitutional basis, statutory processes, and case law interpretations related to right to take challenges. Examine how challenges are explained in Kentucky case decisions cases to identify when and where they occurred, the basis for the challenge, time taken to reach a conclusion, trial strategies that can be gleaned from the opinion, and how the challenge was resolved. Select at least 5 states that self-identify as having a resolution time less than KYTC's average to develop a high- level comparison of their governing state statutes.
