RSF 158, Defining the Value of CMV Screening Data and Improving CMV
Data Utilization

In 2024, the Kentucky General Assembly introduced two pieces of legislation – House Bill 45 and
Senate Bill 380 – that would significantly limit the usage of automated license plate readers (LPRs).
According to state Rep. John Hodgson, the purpose of the House bill, which had several other
unrelated provisions, was to protect civil liberties.1 House Bill 45 would require deletion of all ALPR
data after 30 days with no exemption for commercial trucking enforcement.2 Senate Bill 380’s data
retention requirements are even more stringent, though it has an exemption on ALPR data retention
for “commercial trucking requirements” but has other restrictions, including a ban on usage of
driver focus cameras, which are currently integrated with 12 of the 14 Kentucky Automated Truck
Screening (KATS) systems at fixed weigh stations around the state.3 Both bills would make it illegal
for Kentucky State Police-Commercial Vehicle Enforcement Division (KSP-CVE) or the Kentucky
Transportation Cabinet (KYTC) to share screening data with vendors, technicians, or non-law
enforcement entities, including FMCSA. Neither bill received final passage, but similar legislation
was introduced in the 2025 session.
This project includes the following performance objectives:
• Conduct an analysis of the impact of CMV screening data and inspection activities on CMV
safety and CMV-involved crashes.
• Determine the value of enforcing FMCSA safety and credentialing requirements via CMV
screening data and enforcement activities.
• Identify CMV screening data utilization issues.
• Identify CMV data quality issues.
• Develop CMV screening data utilization strategic plan.
• Identify and develop strategies for ITD Program promotion.
• Create ITD Program
