Abstract
This paper is an excerpt from Chapter 6 of Legal Writing and Analysis, Second Edition (Foundation Press 2015). Chapter 6 deals with "Organizing Legal Writing: The T-R-E-A-T Method," which presents the T-R-E-A-T organizational paradigm for legal writing. T-R-E-A-T represents a refinement of I-R-A-C and C-R-E-A-C and other structural forms for legal writing based on the logical rule-based reasoning syllogism. Chapter 6 discusses the T (thesis headings), R (rule sections), E (explanation sections), A (application sections), and T (thesis restated as a conclusion). This excerpt presents the material on explanation sections and application sections. Thus, the excerpt covers the process of explaining rules and engaging in analogical reasoning through explanatory synthesis and case-by-case presentations. It contains many examples comparing synthesized explanation and application sections and unsynthesized, case-by-case comparisons.
